Alert: The Colorado Supreme Court has ruled the newly enacted Child Sexual Abuse Accountability Act unconstitutional. The law opened the door to minor victims of sexual assault (back to 1960) a right of action without regard to time limits against the perpetrator and any organization that might have prevented or contributed to the assault. The ‘look back window’ (essentially denying statute of limitation defense) was deemed to be a violation of the Ex Post Facto clause of the Colorado Constitution.
