The responsible party, allegedly a power company, has unfettered access to its equipment and even rights-of-way over victims property. Why We Rely on Our Own Investigators
Civil lawyers have no control over the process or the results of the government investigation. In fact, it's a much different investigation with a totally different focus and burden of proof. The government investigation is primarily a criminal investigation. Civil lawsuits are much different, but rely on proof which the victim/resident has the burden to put forward. Civil lawyers cannot compel government investigators to do anything, they go their own direction and may or may not cover all the evidence and make decisions and render options that are based on 'probabilities' (the civil burden of proof). Criminal investigators look for certainty, a much higher burden. Sometimes evidence is hidden from the investigators, so it's important to go to the site as soon as possible to document the evidence which establishes the facts of the cause and origin of the fire. Lawyers cannot work without clients and have little power outside of the courtroom, ethically, so the victims investigators need the authorization of court orders to conduct much of the work. Lawsuits enable the victims lawyers and experts to participate in the process, and observe the tear down of lines, equipment and review of systems. Early lawsuits help preserve the evidence and integrity of the system.

Phased Re-entry
Phased re-entry of Aspen Acres Fire zone starts today on Eastern area from Hwy 78 and 3R Road from east (Pueblo). Homeowners who lost their homes will be allowed in from 8am to 10 am from the entry point to as far in as 4632 North Creek will be escorted to their homes by authorized personnel. Homeowners whose homes are standing will be allowed in in a phased manner from 10 am to 5 pm. This information was released by the Pueblo County Sheriff’s Office (PCSO) on Sunday, July 12 in a community meeting held in Westcliffe.
Meanwhile, Denver Injury Law d/b/a Avery Law Firm (DIL) is investigating the cause of the wildfire and its uncontrolled spread. DIL principal trial lawyer James Avery will host Town Hall meetings at the Pueblo Community College on Saturday, July 18 at 2pm and 3:30 pm to inform home and landowners of legal issues involving insurance, claims and damage recovery.
